I'm not.

Our prosecutions were always questionable.

If you want to charge them with a crime, then you have the problem that nearly every bit of evidence against them was tainted by the fact that they were tortured.

If you want to charge them as war criminals, then you have the problem that we repeatedly violated the Geneva Conventions in dealing with them as POWs.

The ugly truth that of 779 detainees at Gitmo, all but 30 of them have been either returned to their home countries or released. The same with all the PW's we've taken in Afghanistan and Iraq. They've all been released.

The problem was, that a Tokyo or Nuremburg Trial for these guys was never in the cards, was it?

Trump had four years, he never did, either.

The problem they all had was 1) Jurisdiction and 2) Evidence.

These men were not US Citizens and never set foot in the US. So our jurisdiction was questionable at best.

The evidence we had against them was based on torture inflicted on them and others. KSM was waterboarded 183 times. Yeah, the bastard deserved it and a lot worse, but now any evidence or confession related to that waterboarding is tainted... fruit of the poisonous tree. Most of his co-conspirators are either dead or in the wind.

In the podcast above, families of the 9/11 fallen discuss the need for some form of closure. I realize most won't listen to it but it does serve to remind us that there is seldom black and white to any issue; shades of grey are all that there truly is.

From my standpoint, it sure seems as though we should have had some trial by now for the plotters, doesn't it? We can't, of course, because under our rules, the sources and methods would have to be able to be cross-examined. We can't give those up...nor would I want us to. That being said; what about the "right to a speedy trial"? Its where our constitution bumps up against practical reality.
