Brothers fined $450G for chopping down trees on their own land

Michigan brothers face $450,000 in fines for tree removal on their property

"Brothers in Michigan are facing nearly $500,000 in fines for allegedly removing more than 1,400 trees from their 16-acre property without permission...

Gary and Matt Percy removed the trees with the intention of creating a Christmas tree farm on the Canton Township plot. The attorney said that the land was filled with invasive plants.

"This case is about misguided overreach," Pattwell said. "It is unavoidably about whether people who own property are allowed to use it ... We contend the Percy brothers exercised a farming exemption in the local tree removal law to clear the historic pasture behind their business and develop a Christmas tree farm."

Township attorney Kristin Kolb said the brothers were told last year they needed a permit to remove the trees."

....ON THEIR OWN PROPERTY!

Bullshit! This is an example of government gone WAY too far!

I bought my house. I bought my property. I follow my town / city and state laws regarding anything I might do on my property that may effect my neighbors, such as burning refuse and debris on my property, the smoke from which could / will drift from my property.

If I choose to CUT DOWN SEVERAL TREES, plant a few trees, dig a big whole and build a small pond, etc...THAT IS NONE OF THE GOVERNMENT'S BUSINESS!

If I decided to build a small shed in my back yard I should not have to pay the government anything to do it. If I want to collect RAIN WATER in a barrel I should be able to do it without worrying about government intervention.

In come areas / cities of the country the local / state government 'forbids' you from collecting rain water in barrels from the rain falling on YOUR property - some local governments require you to get a permit to do so or will fine you if you are caught doing it.

:wtf:

These guys own property, wanted to clear the land, and wanted to PLANT MORE TREES - are planning on starting their own business, a Christmas Tree Farm...so why the hell should they have to pay the government a damn dime to clear brush ON THEIR OWN LAND, to cut down trees ON THEIR OWN LAND, and to plant more tress ON THEIR OWN LAND?!

Over-regulated, oppressive, overreaching, invasive, controlling....ENOUGH IS ENOUGH!

"The Township also requires landowners to replace any removed trees before cutting them down."

Let that sentence sink in for a minute...

1. 'REPLACE' any removed trees BEFORE cutting them down.'

If I plan on clearing the overgrown land, cutting down the trees that are standing now, and replacing them with Christmas Trees on the land where the old / other trees are NOW, how can I REPLACE those trees if I do not 1st cut the old ones down and REMOVE them, MAKING WAY FOR THE NEW TREES?!

2. 'Replace any REMOVED trees BEFORE cutting them down'.

Ummmm.....How can they be considered 'REMOVED' trees if they have not been cut down / taken out / REMOVED yet?

Again, :wtf:

Don't worry easy Trump will pay their fine

STFU! This is not a platform for butt-hurt snowflakes to vent their frustration at Hillary losing the election and your refusal to accept the results of elections.

If you want to stick to the topic, go for it...otherwise PI$$ OFF.

File this story under the same category as a local government and the local police pulling up in front of your house and telling your 8yo they are shutting their lemonade stand down because the local govt is being cheated out of their 'Permit' fee, 'Business Tax', and / or Revenue Tax by your 8yo!

:fu:

Just one more example of how “not” free Americans have allowed themselves to become... Doesn’t say much for property ownership either...

THAT'S what I am talking about! BS!

- Thank you for sharing!

Yep, I was told I needed soil samples, geologists and engineers involved if I planned to move two VW’s worth of dirt on my own rural piece of property.
Just more extortion from a desperate, failing socialist collective.

It's all about THE MONEY - OTHER people's money to keep the 'Socialist Collective' running.

We have all seen what happens when the Socialist Collective runs out of OTHER people's money - they collapse.

This is the future modern day Democratic Socialist Party members want for this country.

There is no private property.

That was all decided by The U.S. Supreme Court when they took away a dying old lady's home (New London, CT) so the city could give it to a big company that was going to build a new structure that would generate huge property tax revenue.

Except the building never got built. The company was smarter than the city.

The old lady died without her cherished home.

But maybe these folks could find a new angle to take their case all the way now that SCOTU is no longer a wholly-owned subsidiary of The Democrat Party.

There is a maverick in Montgomery county who has defied, defended and won several court cases that officials have silenced. In effect his defense is “where are these entities on my deed. Where does my deed say I will obey regulations imposed that have not existed and I do not agree to” He has won all of them. Part of the commerce clause is that a single party cannot be forced into a binding contract, from an outside 2nd party, they have not agreed to. For example, although it is wise to have smoke detectors the fire department really has no authority over you to force you to place them in your home and no government agency can fine or harm you although they may try.
