It's an abuse of power, to obstruct, on the part of bought off Pubs which will be lawfully judged by the courts. This IS a recess, and the CFPB will be popular except for the brainwashed.

The Senate is in session every 3 days, which is less time than the DOJ says a recess has to be in order to invoke the recess appointment clause of the Constitution. In other words, Obama ignored the advice of his lawyers.

What will Cordray be able to do without senate confirmation?

How long will the courts be tied up contesting whether or not his actions were legal since he was not confirmed in accordance with the law?

Will the CFPB be helpful while under this shadow?

Since the Democrat written law clearly states that this specific appointee has no authority if not confirmed by the Senate (It stays with Timmy at the Treasury).......

He will still get paid and Obama can subtract 1 from the 2,000,000 people who have lost their employment in his term of office.

We only need 1,999,999 more idle Czars to break even.

Ever read the Constitution? Specifically, Article 2 Section 2, here is what it says.

The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

I might be confused, but I don't think any of the vacancies Obama is filling occurred during a recess, can you explain why he is trying to fill them at all given that the language clearly states that is the only time he has that power?

And anything he tries to do will be so tangled up in lawsuits so very quickly he probably won't push it.
 
Oh, dear, it looks like some people don't understand what a recess is. The Senate officially voted on going into recess from December 17 until January 23. Tha mean they are currently in recess. That a few senators come in every few days and wander around playing pro-forma does not mean that the recess has ended.

The Senate is in recess. The appointment will stand.

Something needed to be done, the Repugs are only blocking the appointment under bullshit grounds because major companies in the financial industry pay these politicians off to block any measures at regulation and to support all measures of deregulation. Lack of regulation and oversight is what caused the financial crisis in the first place.

Whether the Senate was legally in recess or not, the law specifically says that the director has to be confirmed by the Senate. This position carries with it some extraordinary powers, and extraordinary access to funds. Confirmation - not appointment - was required by law.

So what can Cordray legally do beyond the limited functions the agency has carried out since it officially opened last year?

Bingo. It just a play by Barry to turn all against Congress.

Congress has lower approval rating than he does so its easy to blame them for everything. The GOP members of Congress of course. Nothing is ever Barrys fault doncha know??
