The Dodd-Frank law says the director must be confirmed by the senate in order to wield his special powers against non-banks.
What will Cordray be able to do without senate confirmation?

The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

Well, any action taken can be challenged in court because he lacks the authority under the act to perform his duties. The act requires confirmation, there is no recess, as the Democrats won't permit one, so he has no more authority to act than you do. And anything he tries to do will be so tangled up in lawsuits so very quickly he probably won't push it.
Well, thats what you get when you recess appoint someone when there is no recess.
Republicans are, once again, playing games.

To stop him from using the constitutional option of a recess appointment while the Senate was adjourned, they've [Republicans] been holding "pro forma" sessions where no business is done, but the chamber is technically working.
Oh well. You want to play, GOP, let's play. A recess appointment is what you get when you refuse to even let a nominee get an up or down vote. That's right. The Senate GOP won't even allow Cordray an up or down vote. It doesn't really matter who gets nominated. Republicans jut don't want the agency to exist. No wonder Congress is so unpopular. Nominees to agencies that were created and signed into law are left on the sidelines because one side hates the POTUS.
The question here ... my question ... is what will Cordray be able to do with just a recess appointment? Will he have any legal ground to regulate the payday loan industry for instance?
Whether the Senate was legally in recess or not, the law specifically says that the director has to be confirmed by the Senate. This position carries with it some extraordinary powers, and extraordinary access to funds. Confirmation - not appointment - was required by law.
So what can Cordray legally do beyond the limited functions the agency has carried out since it officially opened last year?

Something needed to be done, the Repugs are only blocking the appointment under bullshit grounds because major companies in the financial industry pay these politicians off to block any measures at regulation and to support all measures of deregulation. Lack of regulation and oversight is what caused the financial crisis in the first place.
