“UNDER THE JURISDICTION THEREOF”
For some reason the phrase “under the jurisdiction thereof” was included by the Founding Fathers for a reason and the reason was explained.

If this phrase is excluded, the meaning of the 14th Amendment is changed to include children of illegal aliens, but it wasn’t. It is only excluded by people who want to children of illegal aliens as citizens and as anchors for the 20 million that is here illegally.

The constitution is a worthless piece of paper if it is not correctly interpreted and applied. People have given their lives to uphold the constitution so let’s not deface it and trample on it.

The 14th Amendment has been incorrectly interpreted and applied. So either take out the phrase “under the jurisdiction thereof’ so that it will apply to children of illegal aliens or leave it alone and correctly interpret and apply it to exclude children of illegal aliens as the Founding Fathers intended. If you want the 14th Amendment to apply to children of illegal alien, amend it so that is does.

The correct interpretation of the 14th Amendment is that an illegal alien mother is subject to the jurisdiction of her native country, as is her baby.

What 'Subject to the Jurisdiction Thereof' Really Means


The Court essentially stated that the status of the parents determines the citizenship of the child. To qualify children for birthright citizenship, based on the 14th Amendment, parents must owe "direct and immediate allegiance" to the U.S. and be "completely subject" to its jurisdiction. In other words, they must be United States citizens.
