Trump attorney ‘pretty satisfied’ with Colorado ballot decision despite Jan. 6 claims


“We’re pretty satisfied with the outcome,” attorney Scott Gessler, a former Colorado secretary of state, said in an interview with CNN’s Kaitlan Collins. Though, he added that he has not spoken to Trump.

His comments came after District Judge Sarah Wallace said that while she agreed with plaintiffs that Trump “incited” the Jan. 6, 2021, riots on the Capitol, that 14th Amendment’s wording means it does not apply specifically to the presidency. Thus, she ruled in Trump’s favor.

As an aside, it illustrates the political disadvantage of such efforts to keep Trump off of a state’s ballot pursuant to Section 3: any states seeking to do so, such as Colorado, are states Trump likely won’t win, anyway.

Katyal was quick to note that Judge Wallace agreed with the petitioners that the former president took part in an insurrection at the end of his term but used a narrow interpretation to say he is not in violation of the 14th Amendment.
The decision will come back to bit him, not only in an appeal of this decision but in his criminal trials

"There's a factual finding, that the judge said, which is Trump committed insurrection, and then there's a legal part that the 14th Amendment doesn't apply to the office of the presidency. On appeals, Jen, the factual findings get massive deference by the appeals court. It's almost impossible to overturn a trial judge's factual finding."
