Blackrock, you need to update your information. MALPRACTICE is not the same as negligence (the elements of which you outlined). Malpractice only applies to "Professionals," and Professionals are required to be current in their area of expertise - in this case emergency room medicine. If they treat someone in a manner that is not necessarily "negligent," but is not consistent with the current state of the art, they are guilt of malpractice. It is a higher standard than simple negligence.

Back to the subject of this thread: The ER had been notified that Tony was coming, and that his "oxygen level was dangerously low," whatever that means. When he got to the ER, they immediately put him on a gurney and inserted an I.V. This is when he started to experience severe swelling over his head, face, neck, etc. He told his wife he couldn't breathe. When it became clear that he was in serious distress, all doctors in the area came to assist. They tried to insert a "trach" tube, but he was so swollen that they couldn't do it. I believe the immediate cause of death was a heart attack.

The hospital declined to do an autopsy at the wife's request, so they had him removed to another hospital where one was done. No results yet. (that I know of).

The question on everyone's mind is, What the hell was in that I.V.? What could they have possibly given him that would cause such a severe, immediate physical reaction?

I know from personal experience that an allergy is often undetectable until you first experience the substance that triggers it. Maybe they couldn't have known that whatever-it-was would cause such a reaction, or maybe he is one in a million who reacted to it.

Unless the doctor knew he was allergic to the medication or something in it, then there is no way they would win that thing in my state.

I am allergic to so many things I won't allow certain things from a doctor. According to lawyers and many medical professionals that means I am a bad patient. I figure so what cause I know I don't want to take a chance even if they do. Like dye for MRI's, I tell them "no" and that really gets to them but so many people have already reported major issues with that crap so why would I chance it? Doctors don't know your body as well as you do so people should take the time to study it and learn possible causes and options if they haven't already.

Requiring the patient to know what they are allergic to is absurd. A young person likely has no clue nor someone with no history of health issues. There are so many pharmaceutical drugs now, how can a patient be expected to know what might cause an allergic reaction.
Now your talking big pharma and that is where the problem lies. Doctors are not encouraged to seek alternative treatments other than what big pharma advertises as being good. That an doctors are much like other professions when one gets in trouble they all circle the wagons to protect one another even if it is that one is rotten to the core; plus like all the other college educated peeps out there the standards have been lowered to accommodate those who should not be there in the first place. So it all comes down to spend the time to get to know yourself as much as possible and quit putting your obligations to take care of yourself off on someone else if you desire the best treatment possible.

Agreed. Our HC system shouldn’t be counted on to cure you. The profit motive is what drives everything it does. Doctors are just part of the system. They do as they are told, and often that means patients aren’t being well served.

No I’m not. Cost is what the HC industry charges for it’s services. Insurance companies pay those costs.

Ours is by far the most expensive system. Yet the results aren’t very good. Time for a change.
 
My wife's cousin died tragically last week, due to a severe allergic reaction to something given to him in the Emergency Room, where he had gone due to severe flu symptoms. 51 years old, married, two young kids, bad deal all around. (Malpractice suit coming? Don't know).

He was laid out for only one day, funeral Mass on Saturday, followed by a luncheon, where many paid their respects, shared anecdotes, etc.

Upon leaving, my wife offered final condolences to the sister of the deceased, and her parting words were classic: "It's good to hear all these people talking about my brother; maybe he wasn't the heartless son of a bitch I thought I knew." (Back story, their mother had had a long, painful decline to eventual death, and the brother offered no help whatsoever in taking care of the mother's needs).

But if you are older and have siblings, you have probably come to learn that the people in your brothers and sisters' lives (co-workers, neighbors, in-laws, drinking buddies, etc.) know them as completely different people from the ones you grew up with.

Just thought I'd share that.


It happens. I went for an MRI or whatever it is they inject the stuff. But about 10 minutes later I had big lumps break out all over my head. Turn out I'm allergic to that stuff. I would defiantly hope the survivors seek legal counsel. It's also cool to see that another person can see that we live two lives really.
