Where did the arguments on consent come from. This has nothing to do with consent. The defense did not use consent. In the muslim mind there was no right to refuse. Actually works similar in most states. Is a higher aoc to marry without parental consent, a lower one for-with consent, then another even lower for judicial consent and/or parental consent. Here it's Missouri it's 18 without, 15 with parental, and lower still but not specified for with judicial consent.

Usually the consent comes where there's a pregnancy/child involved where 'married' is better than not-married according to that reliigous sorta importance of marriage and 'wedlock.'

In most instances, a judge would not allow a minor under the age of 16 to be married. Marriage laws do NOT trump statutory rape laws.

They may allow it if it is two minors close in age and the female is pregnant and they have been emancipated from their parents/guardians. However, this is not something that happens in Massachusetts. We don't hear about 12-year-olds being married, so it would be EXTREMELY rare occurrence, and the judge would have to answer to the public as well.
