Obamacare, religious freedom, and same-sex marriage equality are all on the judicial agenda.


Will the Roberts' court overturn Obamacare? Or clarify the legal case for or against same-sex marriage? Or determine just what “hate speech” is as opposed to freedom of speech.

On Obamacare the Justices will surely disallow the subsidies, which are contrary to the letter of the law. They will point out the obvious remedy: Congress needs to modify it. The GOP in Congress will do so but will scale back Obamacare and alter it so it might actually work. Adding things like opt out clauses and repealing the individual mandate.

On gay marriage they will affirm their holding in Windsor that marriage is a matter for the states to decide.

On campaign finance they will again affirm that the 1A actually means Congress can make no law abridign free speech.

The courts have sided with ACA and homosexual marriage right down the line. I don't see what is going to be so different in 2015.

Paint my house this is not about the mandate, it is about the subsidies two high courts a few months ago made rulings in to opposite directions and we know the hobby lobby ruling.

If you knew the court you'd know an interesting thing, they look the intent of laws and they, unlike you, can read between the lines. They know what Congress wanted to do even though a word or two was missed.

Why would they overturn ObamaCare when they already gave it the green light a few years ago?

They wont overturn it. Just like HobbyLobby they will reverse a regulatory decision by HHS which is contrary to the plain law. They will explain that Congress is the proper venue for fixing problems, not HHS. And Congress will indeed go back and make a wholesale overhaul of the law and dare Obama to veto it.
