The conduct against a UNIFORMED combatant by another signatory to the Geneva Accords WOULD be contrary to the Accords. If they carelessly referred to it as "torture," that's unfortunate but hardly binding.

Tax evasion, for example, IS a crime.

Willful violations of the Constitution by the Administration (which is, of course, sworn to uphold the Constitution) also kinda qualifies.
