Obviously Cuomo can’t keep those who are extreme rightists out of the State, nor compel such residents to leave.

But Cuomo is correct that New York is required to obey the Constitution and its case law with regard to a woman’s right to privacy concerning abortion, same-sex couples’ right to equal protection of the law concerning the right to marry, and that the rights enshrined in the Second Amendment are not unlimited, and are subject to reasonable restrictions.

Cuomo is wrong, of course, with regard to his position on so-called ‘assault weapons,’ but that’s a matter currently before the courts for final determination, and until such time as a Federal court rules on the issue, the ban does not violate the Second Amendment.

Consequently, it’s perfectly appropriate for Cuomo to declare that his state will follow the Constitution, where efforts by the extreme right to violate the Constitution and the rights of state residents will be contested.
