It's not a person until it's born. Which is why we have different words to define the gestational process.

Notice women who carry a pregnancy to term don't say they have a baby. They say they're going to have a baby. Which the two things are different. She's saying she will have a baby 9 months later when it's born. She's not saying she has a baby right now while she's pregnant.

However if you want to go by your definition:
