You call yourself a Constitutionalist and don't understand how the system works? A law stays a law until someone comes up with a reason for it to be considered unConstitutional... then the court decides whether it is a good argument enough to hear the case... and then they make a ruling.

Yes, I understand that "case law" refers to existing rulings which made new interpretations of law and, therefore, can be cited as precedents. And "statutory law" is law enacted by a legislative body. The president is following a statutory law.
The statutory law in question is Title 8. This is enacted as an enumerated power of Congress. You do understand that Congress has certain enumerated powers and what those are, correct? They are not up for reinterpretation. Civil laws and administrative laws are. This is not one of those. You can challenge it... that's what's currently happening... you're going to FAIL because it's an enumerated power of Congress and it's simply not something that can be reinterpreted.
