That isn't how orders are determined to be lawful, or unlawful. The president isn't required to ask permission from anyone to take military action.The military works by carrying out the "lawful" orders of their commanders, and the commander-in-chief.
They are duty bound to refuse to carry out "illegal" orders. Knowing that Trump as commanmder-in-chief gave an order while in consultation with his military and civilian advisors, would give them confidence the order was lawful.
Knowing the president did not consult any of his advisors, before ordering an unprovoked action could be an unlawful order.
