A terrible miscarriage of justice but that happens more than people would like to think......the case in Georgia not that long ago being another.
Anyhow the case here in Clearwater concerned a not too bright white fellow in his forties who had what could be referred to as a peculiar obsession with people parking in a handicap spot when they were not handicapped.
Not being too bright he probably did not realize the risk he was taking by approaching such people and telling them they should not be doing that.....it is really not that uncommon of a thing and I have noticed it myself as I am sure others here have and the police probably do not enforce it like they should.
Anyhow....having said all that--let us look at what actually happened to the poor fellow named Drejka......he had stopped at convienience store close to where he lived which he was prone to do and had done so many,many times.....he spotted a car with a black woman sitting in it parked in the handicap spot...he circled the car to see if it had a handicap sticker which it did not....he then politely approached the black woman and told her she should not be parking in a handicap spot......whereup the black woman went ballistic...and she was in essence yelling at
drejka.....telling him when her boyfriend came out of the store he would fuck drejka up. Why was she so outraged and why did she respond in such a angry outburst? One can only speculate.
But this was not Drejka's first rodeo....he had gotten into it with other people doing the same thing....the owner of the store who knew Drejka as a regular customer....advised him he should not be doing that but Drejka paid no attention.
A young white guy going into the store saw and heard the commotion....had no idea of what was really going on but went into the store and seeing a black at the counter....assumed correctly that the woman outside in the car was his g/f and he told him....dude --some white guy is outside messing with your woman.
Thus the black guy with a history of violence was quickly provoked 'the judge would not let his previous history be discussed in court' charged outside quickly in a furious mode....drejka so busy arguing with the woman did not even see him coming.....the black guy shoved Drejka to the ground in a very violent and forceful manner. Then he stood over him within a very close distance approx 6ft away.....easily within striking distance.
Drejka sprawled out on the ground not knowing what might be coming next quickly reached for his concealed weapon and shot the black guy who then ran back into the store and died.
Drejka was found guilty by a mostly white jury as I recall.
Why was Drejka found guilty when I lot of people maybe even most people would believe he was in reasonable fear of his life......the black guy was hovering over him....and Drejka had every reason to believe the attack would continue and thus he was in fear of his life and or great bodily harm....which covers all the bases for use of lethal force in self defense in the state of Florida.
Unfortunately for Drejka the local media stirred up blacks in the neighborhood and a protest began....even though at that time Drejka had not been charged with anything and he should not have been charged with anything......but with the growing protest movement getting a lot of publicity....the kind of publicity a tourist town like Clearwater does not need or want.....so the political big wigs brought pressure to bear on the police dept and drejka was charged and jailed.
Drejka was not a sympathetic figure....and many said he was stupid for approaching people illegallly parked in a handicap spot...though not to long before the incident.....the local msm ran a series of investigative stories about that same topic....people parking in handicapped spots when they were not handicapped.
All of the media pre-judged and condemed Drajka before the trial began....except for one well known and well respected journalist....who decided to interview Drejka in his jail cell to get his side of the story....the result of that story got the Journalist fired because his p.c. bosses thought he showed sympathy towards Drejka.
Finally the trial began.....two things became quickly obvious......Drejka was a poor man who could not afford a good attorney....it was in fact painfully obvious. The second thing was that the prosecutor was very strong and persuasive and had no problem leading the jury around by the nose so to speak.
He told the jury over and over in a very forceful way...pounding on the table....just watch the video.....just watch the video.
The stores video camera had captured the entire incident.
The video was shown but in a manner that completely destroyed the reality of the event....it was shown in slow motion....the problem that caused was it gave the jury the impression Drejka had a lot more time than he actually had to make the decision to shoot or not to shoot....in reality if he was to prevent a possible continuation of the attack....he had to act very,very quickly which he did.
A competent and non biased judge would not have allowed that video to be shown in slow motion....that was outrageous.
Drejka's defense team did a poor job of convincing the jury that drejka had to make a very fast decision.
Drejka was not suprisingly .....convicted and sentenced to a 30yr. term. The jury foreman said the video convinced him Drejka fired witrhout due consideration and thus was guilty of murder....he said nothing about the jury even considering if Drejka was in reasonable fear of his life....the jury foreman was proably represenative of the jury...bunch of dumbasses.
Drejka was just a average guy who worked as a tree trimmer and had a clean record.....unlike the black guy with his history of violence...........Drejka had never been arrested or convicted of any crime.
This story should serve as a warnig to all who carry concealed weapons....be very,very careful and only shoot as a last resort .....but even if you are careful and even if you were really i fear of your life or of great bodily harm....a jury still might convict you....most especially if the guy you shoot is black.

First of all you like the jury do not realize how quickly this all went down.....of course the state claimed the black guy was backing away but in reality what he did when the gun came out was to sort of lean backwards....Drejka in a state of shock did not even notice that....he felt he must act quickly and the big black guy hovering over him constituted a significant threat to his life and or great bodily injury.
You like the jury have the benefit of hindsight.....your life was not in danger....so too easy to say drejkas life was not in danger....if he had not pulled out the pistol ....impossible to say what the black guy might have done....he could easily have beaten drejka to death and how any videos have we seen of blacks beating people to death for much less than what drejka had done?
