Biden doesn't really care if his EOs are constitutional or not, he's just doing it to appease the Far Left. If it gets struck down, so what? He can say, "C'mon man, I tried, right?" And if it stands then he's got a political victory. Plus, if it fails then he can go to the voters and tell them, "you better vote for me and my party if you want us to put the right judges into positions that help us do what you want us to do". IOW, he's got nothing to lose.

Relying on horribly politicized courts to do the right thing doesn't provide much hope for anything.
