And your fact pattern is false. How expected. She wasn’t charging towards anyone. There was this big ass door there.

She was unarmed as were all the protestors or “mob” inside the building. There was zero legal justification or practical need to have shot her.
 
If this was a white cop and the victim was black and marching with BLM the cop would already be in prison....

She's the one with the American Flag on her shoulder. Which is proof, in and of itself, that she must be a bad person.

So, Michael Byrd took it upon himself to shoot her. In the throat. She died. Horribly

After which, the Brave people that run DC decided to house him at an Air Force Base. In a very, VERY expensive suite. Paid for by -- Us. The American People.

So, what do you think? Will Byrd be prosecuted for the murder he committed?

You're correct I meant to write armed police officers, Thank You for pointing that out.

Er um... the window was a bottle neck, the best "the mob" could do was try to climb through one by one, Babbit could have been physically restrained and as I said a blast of OC spray through that window would have taken the starch out of everyone's jammies given that it was an enclosed space.

But hey it's okay he bypassed all the non-lethal options at his disposal and went straight into execution mode, after all Ashli Babbit was a Republican and thus deserved what she got. If this same scenario had played out during the summer of love riots, I suspect all the bloodthirsty partisans here claiming she deserved to die would be singing a different tune.
Byrd was not required to give them the benefit of the doubt due to everything they had done prior to arriving at that place and point in time - the threats, the attacks on other police officers, hell what they said to the police officers they convinced to move out of their way so they could begin breaking out the door's window - watch the video, it shows they tell the LEOs that they didn't want them to get hurt and that they wanted them to go home).

When a police officer tells you to stop and they have their gun pointed at you, you take your chances if you opt to proceed. Like I indicated earlier, that one shot neutralized their attack and all attempts to breach that door through the window they broke out apparently for that purpose, immediately ceased.

Malice is a required element of murder. Byrd did not shoot her out of malice, she was shot because his job was to protect the lives of the Congressional members from the mob that she was leading to them.

If Babbett had stayed on the other side of the door she would not have been shot. It was only when she attempted to breach the LOCKED DOOR (it was locked to keep people out) was she shot.

There were two Capital police officers on the other side of the door and were approaching Ashli Babbitt just before Byrd shot and killed her. The policemen immediately left...

The two police officers who the mob persuaded to leave so that they didn't get hurt as they continued their assault on the door that stood in between them & their prey?

Those two Capitol police officers?
