He deserves his fate, but it sets a dangerous precedent.




Last November, federal prosecutors accidentally revealed, in an unrelated court document, that a sealed indictment had been filed against WikiLeaks founder Julian Assange. Many people concerned with civil liberties, including some who despise Assange, were alarmed by the idea that he could be punished for his role in exposing American government secrets. “If Assange can be prosecuted merely for publishing leaked classified documents, every single media outlet is at risk of prosecution for doing the exact same thing,” the lawyer Bradley P. Moss wrote in The Atlantic.

At the time, the public didn’t know what the actual charges were. Now that Assange has been dragged from the Ecuadorean Embassy in London, where he’s lived for almost seven years, and is facing extradition to the United States, we do. He’s been indicted for conspiracy to commit computer intrusion, a result of his alleged attempts nearly a decade ago to help former Army intelligence analyst Chelsea Manning crack a password to a government computer.

These charges do not pose quite the threat to a free press that some feared, because hacking is not standard journalistic practice. “The indictment does not charge Assange for the act of publishing, which would have been a serious Rubicon crossed,” Ben Wizner, director of the American Civil Liberties Union’s project on speech, privacy and technology, told me. But, as Wizner emphasizes, that doesn’t mean we shouldn’t be worried about what Donald Trump’s Justice Department is up to. Elements of the Assange indictment could still set a dangerous precedent.
 
This attempt by the US government to bring Assange to trial is more an attempt to get him found guilty to scare the media into never publishing any kind of classified information, ever. Assange is just the pawn.

"Assange is charged with conspiracy to commit computer intrusion and is presumed innocent unless and until proven guilty beyond a reasonable doubt.

"If convicted, he faces a maximum penalty of five years in prison. Actual sentences for federal crimes are typically less than the maximum penalties. A federal district court judge will determine any sentence after taking into account the US Sentencing Guidelines and other statutory factors."

Being accused is not being guilty. After this much time I find it ludicrous to be going to all this effort when the max penalty is 5 years in a federal pen. Ergo, the government is teaching the media a lesson IMHO. But, you are certainly entitled to your opinion.
It has nothing to do with publishing classified information so it cannot be a warning to the media.

He is charged with conspiring to hack government computers not with publishing classified materials, so if it is a warning to the media, it must be a warning not to hack government computers.
 
Assange worked with Russian intel in the run-up to the 2016 election to disseminate hacked emails in ways that he believed would be most damaging to the United States of America.

That said, he should never be punished for publishing anything that he legally obtained.

That's the question here. Did he conspire to obtain info illegally?
Did he get it from the Russians? Did he think Russians could "legally" get info from the DNC servers?

That's not relevant. If he didn't assist them in obtaining it illegally, then he's all good. While reporting classified info that one hasn't obtained illegally may compromise national security, it isn't and shouldn't be illegal.

What always got me about Wikileaks was this. They hack every computer in the western hemisphere and publish stuff to embarrass those in power under the guise of serving the public. Yet they never seem to hack any computer belonging to terrorists organizations like Al Queda, ISIS, or even North Korea, Iran, Syria etc...

It doesn't seem to occur to Ben that the deep state simply made the hacking charges up to get their hands on Assange so they can't be accused of going after independent journalists that embarrass them....

Doesn't this case just hinge on what Assange did to get the information?

If that's the case, we're simply talking about whether he broke laws, not freedom of the press.

Assange was in that embassy for 7 years, guarded by UK puppet police around the clock because he violated bail for fake rape charges, it took a regime change in Ecuador to get him out of there and the entire swamp is gloating how he is their property now and 'justice' will be done.... but it's all because he 'conspired to hack' a computer years ago.... it has got nothing to do with his publishing and exposing the dirty crimes of the deep state...

Don't overreact and worry about the freedom of press and what should be fundamental human rights... it's simply because Assange broke the law...
