You're right, the first SCOTUS did only have 6 justices, but rulings were required to be a 2/3 majority. As the nation grew, increasing the number of districts, they SC also was expanded until finally they decided to settle on the number as being 9.

oh i don't disagree that the president will have to nominate a moderate to have a shot at a vote, but I also think that more than that it depends on the republicans in the senate acting like adults and there doesn't seem to be much hope of that at all.

that is the thing - there is no possible way that they will get a nominee approved that will be as reliably right-wing as scalia. it just won't happen. the court will be more liberal no matter what happens with the nomination process.
