They had already had their hearings in the past. They had valid expulsion orders on file. They were subject to deportation upon contact without further proceedings. If you murder someone and flee after being convicted, before being imprisoned, the state doesn't have to provide any further due process after it recaptures you, it just tosses you into prison and then tries you for the escape.

The 137 who were deported under the Alien Enemies act were given their order by Judge Boasberg who has been slapped down multiple times by appeals courts for exceeding his authority in attacks on Trump and officials in his administration. He's a partisan hack using his office for furthering a personal grudge.

No court in this country sentenced anyone to be imprisoned in CECOT.

Her theory is that the Trump administration is too stupid to have understand the plain language of his order to stop removal.
