It’s a felony when it’s done in furtherance of another crime, which doesn’t have to be Trump’s crime.
Then it could only be used against the person who committed the alleged crime, NOT Trump.
 
But Trump didn’t violate FEC regulations and the ex-head of the FEC was prepared to testify to that fact.
One, not the role of a witness to declare findings of law in a court.

Two, it doesn’t matter if Trump violated FEC regulations. He falsified records to cover up Cohen’s violation is enough.
