If the NDA was filed to protect the image of the TRUMP organization, then it would be a legitimate business expense. If Trump had sex with Stormy on behalf of his role as Chief Executive, then it would be a legitimate payment.

But Trump had sex with her as a private citizen and was concerned with his personal reputation

The payments to Cohen did not come from a business account.
No tax returns were entered into evidence.
The prosecution has not alleged tax fraud.
No tax authority was called to testify.

In fact, no State authority from any department has testified as to why the records were fraudulent, and how they were deceived by the classification as "legal expenses".

That would not be a grounds for a reversal. It's the trial jury's duty to assess the credibility of the witnesses, and the defense's job to impeach their credibility.

The appeals court doesn't look at the facts of the case- they only look at whether the verdict was properly reached and was it a fair process.
