Then there is the issue of servers. Where did Powell and Rice’s staff have their servers? Who knows, and who cares? Maybe they were private with special security and no public access. Or maybe they were just an AOL server. Whichever it was, they would be just as open to hacking as the State Department servers. In fact, the State Department general email system has been hacked multiple times, with terabytes of information improperly downloaded in 2006 alone. There has been no indication that the email accounts of either Powell or Rice’s staff were compromised.

Powell may have made one mistake in all this. He has said he never backed up his emails or printed them out; that was necessary to comply with some of the preservation rules detailed in the Federal Register. Of course, that doesn’t mean they can’t be recovered, since the FOIA staff is now reviewing his emails.

The bottom line: Democrats may try to turn the revelations about the email accounts used by Powell and Rice’s staff into a scandal. They may release press statements condemning the former secretaries of state; they may call for scores of unnecessary congressional hearings; they may go to the press and confidently proclaim that crimes were committed by these honorable Republicans. But it would all be lies. Powell and Rice did nothing wrong. This could be considered a scandal only by ignorant or lying partisans.

So there is no Powell or Rice email scandal. And no doubt, that will infuriate the Republicans who are trying so hard to trick people into believing Clinton committed a crime by doing the exact same thing as her predecessors.

Colin Powell did go out to dinner with Madeleine Albright and other former secretaries of State to give Hillary Clinton tips on what to do. We know that-- COLIN POWELL admits he sent an email to Hillary Clinton stating this.

However, "He did write former Secretary Clinton an email memo describing his use of his personal AOL email account for unclassified messages and how it vastly improved communications within the State Department." The following is from the State Department's manual. Take note of the date of it's passage...11-14-2011. I've highlighted one paragraph in red to underscore that there were rules in place regarding preservation of work related emails...rules that Hillary Clinton disregarded completely.

a. Users are to actively manage their email accounts and avoid retaining unnecessary email in their mailbox.

b. Email originators and recipients are required to determine if an email is appropriate for preservation and, to the extent necessary, properly archive the email outside their email mailboxes. SMART users who identify a working email that needs archiving should click the Convert to Archive button in Microsoft Outlook. · Messages documenting routine activities containing non substantive information, such as routine notifications of meetings, scheduling of work-related trips and visits, and other scheduling related activities.

· Messages containing drafts that do not provide understanding of the formulation and execution of basic policies, decisions, actions, or responsibilities.

· Messages containing quasi-official notices including memoranda and other records that do not serve as the basis of official actions, such as notices of holidays or charity and welfare fund appeals, bond campaigns, and similar records.

· Material retained for reference while working on a project that is no longer needed when the project is complete, provided the material does not warrant long-term preservation.

· Personal exchanges unrelated to official business.

d. As with other documentary materials, users must take steps to preserve emails where required by legal mandates (e.g., emails relevant to actual or anticipated litigation or in response to pending requests from Congress or under the Freedom of Information Act.) Email systems administrators must also take steps to preserve emails when authorized.

e. Email messages are records when they meet the definition of a record as stated in the Federal Records Act (44 U.S.C. 3301). Email messages are records when:

(1) An agency makes messages related to Federal law or in connection with public business; and

(2) There is information regarding Governments which provides informational value of the data.

f. Email message creators and recipients must decide whether a particular message is appropriate for preservation in the Archive. Consistent with 5 FAM 443, principal categories of materials, including email, that must be preserved are: records that document the formulation and execution of basic policies and decisions and the taking of necessary actions; records that document important meetings; records that facilitate agency officials’ and their successors’ action; records that make scrutiny by the Congress or other duly authorized agencies of the Government possible; and records that protect the financial, legal, and other rights of the Government and of persons directly affected by the Government’s actions.
