The car kept going even after she was shot so evidently he did have a chance to avoid it. Otherwise he would have been hit. However, with that said she obviously had no real concern for his safety and gambled with his safety. So I don't really condemn his action. She had the wheels turned to the right, which is not straight at the officer, and the officer literally had put himself in front of her vehicle. Except officers are specifically trained not to go in front of the vehicle in situations like these. You cannot execute someone for fleeing.

The officer had room to step out the way of the vehicle. If the officer has the ability to get out of the way of the car, and there is no justified reason they would have to think she posed a continued threat, then why shoot? If in that moment he was fearing for his life, wouldn't it make more sense to immediately get out of the way of the car that is turning away from him? why continue standing in front of the car while drawing his weapon? Usually the immediate threat is for things like if someone is posing a threat such as they have a knife and they keep walking towards you and ignoring your commands. In this case, whether he discharges his weapon or not makes no difference to the immediate threat. If he steps out of the way, the immediate threat is gone, if he stays his ground and discharges his weapon, it makes no difference to his immediate safety. In both cases, it does nothing to stop whatever actual threat he is facing, and in both cases, once the car is past him, any immediate threat is gone.
