No. The standard is reasonable fear. The codicil is the legal and factual doctrine in Texas that you can't start a fight, kill the guy, and claim self defense.

I don’t care which state. If someone trespasses on my property and refuses to leave, I’ll exterminate the vermin and I don’t care if that person fights back.

It was not private property. That case would never go to trial because the defense would have immediately pled out. Surprised they did not here.

So let’s say I’m standing on the corner in a poor, urban city and a group of black youths are walking down the street towards me - and looking at me. I am in fear of my life. Can I take out my gun and blow them all to smithereens?
