As I said on another thread, I think these Article IV cases will be significant.

It's going to be hard for states to support gay marriage for those out of state marriages, but refuse in-state gay marriages.

It would be hard for the state to recognize "partial marriage" - marriage that applies to death certificates, but not inheritance, etc. For each of the numerous references to marriage in state law, some supportable determination would need to be made concerning whether out of state same sex marriages would be honored.

And, for every one of these decisions, there will be cases before the courts where states will be fighting losing battles for the crazy choices they've made.
 
“This is not a complicated case,” Black wrote last summer. “The issue is whether the State of Ohio can discriminate against same sex marriages lawfully solemnized out of state, when Ohio law has historically and unambiguously provided that the validity of a marriage is determined by whether it complies with the law of the jurisdiction where it was celebrated.”

True, it’s not a complicated case.

Just as marriage law can accommodate same-sex couples in one state, so too can the marriage law in another state accommodate same-sex couples, whether that state is issuing marriage licenses to same-sex couples or not.

What we’re witnessing is unjust laws designed to deny same-sex couples their equal protection rights, predicated solely on animus toward homosexuals, being systematically dismantled by a consistent application of law and reason.

Peter Sprigg, a senior fellow for policy studies at the Family Research Council, said earlier that the case was “representative of the strategy advocates for redefining marriages are using,” in which “they make emotional appeals rather than rational ones.”
Incorrect.

No one is seeking to ‘redefine’ marriage; indeed, same-sex couples wish only to access marriage law exactly as it exists now, unchanged, the same marriage law opposite-sex couples have access to.
