False. He was never adjudicated as a member of a gang. It has nothing to do with his ability to be deported.

His attorneys only argued in District Court that he shouldn't be removed to El Salvador per the Order of Removal, but that Order allows removal to any other country.

This just flat out false. Here is the adjudication of the immigration judge and nowhere does the judge indicate he was a member of MS-13.

As a matter of fact the judge goes to great length to explain that Garcia was running FROM gangs.

I don't see where he was running from MS-13. And the original hearing, the judge adjudicated him MS-13. This matter you posted was his request for asylum, which was denied, and relief under CAT, thus no removal to El Salvador only. A different issue.

Regardless, he was in country illegally and was issued a Notice of removal, except to El Salvador, and that order is still valid.
