Nope, the immigration judge adjudicated him a member of MS-13 and the appeal board agreed.

This just flat out false. Here is the adjudication of the immigration judge and nowhere does the judge indicate he was a member of MS-13.

As a matter of fact the judge goes to great length to explain that Garcia was running FROM gangs.



His attorneys only argued in District Court that he shouldn't be removed to El Salvador per the Order of Removal, but that Order allows removal to any other country.

That is how immigration law works. Say the statutes, says the Supreme Court.

So why didn't the Trump Administration remove him to another country in 2019?

I don't know. Its just never been used when there was no war, to my knowledge. But, I suppose they could go with guilty until proven innocent, and not need for a trial or hearing to prove it. This is a strange court, with some members legally on the take.

No sooner than I post that, the SCOTUS sides with the President on the issue. I'm still waiting on the news sites to update.
 
Still, let's make sure those we deport to el salvadore are indeed gang members

I said it could happen. Looks like it did. Searched after decision outcome post. Didn't see FOX but CNN verified it, even if they are mainstream media.
 
#1 He was denied aslyum in 2019 during the Trump Administration. He could have been deported to anywhere in the world EXCEPT El Salvador. So he's been awaiting deportation, but the Trump Administration never moved to deport him.

#2 He wasn't really deported as in returned to his home country, the country he was barred from being sent to. He is a US prisoner being housed there. The taxpayers are paying for his incarcertation.

#3 If the Trump Administration (current) can send him there on a contractural basis to house detainees for $6,000,000 of tax payer funds per year. The Trump Administration can say we want him back.
