Best friends: EU threatens Ukraine to cut off electric supply.
The EU is already reaching their hands out at Ukrainian assets. They want Ukraine to make Ukrenergo "independent" from the government by appointing "independent" Supervisory Board members.
""At this time, the Supervisory Board of Ukrenergo is capable only of quorum requirements, and will cease to be so on December 9, 2024, when the mandate of one independent member ends. However, given its composition, the Supervisory Board is no longer in a state where it can make independent decisions. Therefore, it is critically important that all four independent members are appointed without delay – no later than December 9, 2024, and then the chairman of the board is appointed," the letter says.
The second point is the question of the charter of Ukrenergo. "To ensure that the independent supervisory board can fulfill its task of protecting the functioning and commercial activities of Ukrenergo from government interference, the charter of Ukrenergo should be revised in order to strengthen the role of the independent supervisory board in decision-making," the letter says.
Thirdly, the Energy Community Secretariat reminds the Ministry of Energy – which is now both the policymaker in the energy sector and the shareholder managing the company – of the obligation to create a separate unit that would independently coordinate the operators of the fuel and energy complex.
The secretariat currently has no information on whether such a unit has already been created and whether it is functioning properly.
They also touch upon the order of the Ministry of Energy 408/2022, which establishes a mechanism for the organization and functioning of internal control and risk management in the ministry and subordinate enterprises, including Ukrenergo. As noted, de facto, this order created "a parallel system of control, which led to conflicting lines of responsibility, in particular with regard to responsibility to the responsible supervisory boards.
"Order 408/2022 should be reviewed to ensure that Ukrenergo can function completely independently of the intervention of the Ministry of Energy and the Minister of Energy," the letter says.
The Energy Community Secretariat emphasizes that each of these points is already a sufficient reason to restart the certification procedure, as each is an obstacle to the independent functioning of Ukrenergo.
"We ask the National Energy and Utilities Regulatory Commission to assess Ukrenergo's compliance with the requirements for unbundling and reopen the certification procedure if compliance in the above issues is not achieved by December 9... If compliance is not ensured by December 9, the National Energy and Utilities Regulatory Commission is asked to re-start the certification procedure for Ukrenergo," the letter concludes.
Oleksandr Kharchenko, an expert on energy issues and director of the Energy Research Center, warned that in the event of the loss of Ukrenergo's certification, Ukraine could lose electricity imports from Europe, and this is a serious threat before the new winter in the face of Russian shelling.
Earlier it was reported that the EU plans to increase the capacity of electricity exports in Ukraine, which is part of a plan to "soften" the passage of winter in the face of Russian shelling of the energy system.
This should cover about 12% of Ukraine's needs. Therefore, the possible revocation of certification means that Ukraine may lose access to these volumes."
