Don't think so, that makes less sense than the other way, plus that serving 2 years or less of another's term doesn't apply to sitting presidents.

.it's important to understand things that are real. I don't think a trump 3rd term is a real possibility. I'm fairly certain he would lose that fight..if he even tried.

I think we both understand what is real.

We can look at difference scenarios and talk about the dangers of this, that and the other.

There is a chance Trump could pull of a dictatorship. It's been done before and it'll be done in the future too. US democracy is weak, the politicians are greedy (on both sides), the US is certainly moving towards something that is dangerous and it's been happening since the early 1980s with the Libertarians losing the election in 1980 and the Koch brothers deciding to change how the right functions.

They've chipped away at democracy, increased the bribability of politicians, including Congressmen and women, presidential candidates and Supreme Court members.

It's not going to end well. Whether it happens sooner rather than later might just be down to luck.

Neither the Constitution, nor the War Powers Act allows the president to remain in office after his term expires. In fact there is no provision for a president to remain in office after the end of his term, neither war, national emergency or civil uprising.

Using force to remain in office would probably result in impeachment or use of the 25 amendment to remove the president . In any democratic republic, the chance of a president seizing control is aways a possibility.

I don't think Trump would go this far to remain in power. However, his behavior leading up to Jan 6, his obsession with the loyalty of his staff, and respect for dictators, makes one wonder.

I don't think he is planning on losing congress in the midterm. I think the purpose of his government firing and tariffs are to raise trillions of dollars which he will use for a huge tax cut, helping business in the recession. In other words, buy the midterm election.

I'm saying he is expecting to not keep the house and senate at mid terms. I don't see that as giving him credit for anything
 
If you're right - and you;re not , bust just for sake of argument - why do you suppose no 2-term President - Clinton, Obama - has not tried to do this?

If Trump were really running for a third term he wouldn't be singlehandedly destroying the markets in a bid to win votes.
 
Since the twelvth amendment was ratified before the twenty-second, how do limitations of the twenty-second apply? The twenty-second seems to be saying only that the VP must be a natural-born citizen and at least 35 years old.

I'm not sure how Trump would be restricted from a term as VP.
The 12th just says a VP must be eligible to be President.
The 22nd says that a person can only be elected twice.

A twice elected President as a VP seems to hinge on whether a VP is elected. That is a semantic battle.

And the path from Speaker does not involve elections at all. You would need to find 2 people willing to go through the process to just step down. That might be an impossible bar to climb.
 
If a person has already been President for 2 terms, he cannot be President again; as such, he is also ineligible for the office of VP.
That's the way everybody sees it. It is not what the 22nd says. It only mentions that you can only be elected twice, for a maximum of 10 years.

As a VP, succeeding a President who dies, steps down. As Speaker of the House if both the President and VP are no longer there.
 
I would say no. Because even if the house or senate selected him then it would be by election that would be done by congress. Congress would vote in a tie breaker. So there is no avenue for Trump to be reelected.

No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President,

it also indicates that he cannot seek election a 3 time as election is the key word.

How can a president be elected?

Trump was elected twice and that is all folks.

Now if Trump ran for VP would be interesting. If the person who was elected President quit and let Trump in.

Yet who would be stupid enough to do that.

To ignore the constitution for one man would open a can of worms.

Still I don't believe Trump can win another election based on his performance so far.

Everyone now knows that he really wants to own the US as a business venture.

The twelfth amendment states that any n order to be eligible for VP you must also be eligible to run for POTUS
