The exchange that allows ABC to temporarily own the block of frequencies that they license by contract from the US Government that directly affect Kimmel's lies are:

1) that they operate in the public interest.

2) that they don't intentionally perpetrate hoaxes especially when it regards crimes and catastrophes.

3) that they do not intentional distort the news.

These are the regulations that the broadcasters freely and voluntarily agree to abide by in exchange for the contractual use of broadcast airwaves.

Fox News doesn't have a licence with the government to use over the air broadcast frequencies. They broadcast over private cable systems and satellite. Therefore, there is no voluntary regulations of their speech. That is why cable broadcasts nude scenes and cuss words and broadcast television does not, though both are express rights to speech and expression granted by the first amendment.

The regulation against intentional hoaxing and distorting the news is also voluntary, a stipulation of receiving a license to broadcast over the air.

A similar example of voluntary, contractual regulation of rights is signing a contractual obligation to the US Military, colloquially known as "enlisting".

In exchange for the education, retirement, healthcare, training, experience and honor of service in the military, my enlistment contract also restricted certain rights, such as the right to free speech and the right to freedom of movement. This is a totally voluntary contractual regulation of personal rights... but violation of these regulations may land a service member in federal prison.

It is the same type of voluntary regulation that ABC, NBC and CBS have entered with the US Government and the FCC.

They can freely end these regulations by ending their license agreement for over-the-air broadcast with the Government of the United States and relinquish that block of airwaves to another company.

All ABC Stations and affiliate stations are licensed and regulated by the FCC... As is every other station that broadcasts over public airwaves.
