Jack Smith had NO STANDING WHATSOEVER

Can he be charged with malicious prosecution?

When a grand jury is involved and agreed to the new charges are felonious, Jack Smith cannot be gone after for malicious prosecution, especially now that he did this new prosecution based on the recent ruling by the Supreme Court that presidents have immunity when in office and doing the job of president.

This indictment keys on what he did after he was out of office, meaning his immunity no longer applies.

One thing that can be said with 100% certainty. If the charges Jack Smith brought to the grand jury were not based on existing laws and enough proof was shown that he could be guilty, then the grand jury would not agree to the charges.

Trump will have to defend himself in court if not elected. and given that these were felonious charges, if found guilty, this is definitely jail time. He was found guilty by a jury of his peers once already, meaning that you and all the other Trump lovers need to hope that he wins the election.

No doubt about it though, since Harris and Walz got the nomination and the response seen from the public, Trump is sweating big time.
