That said, there is absolutely no reason why the current Immigration Law can’t be now amended to nature that visa overstays get classified as “criminal” AS WELL as having negative impacts on immigration eligibility.

Yes, that can be done. But if you look into the 2023 overstay report I linked to another poster, "biometrics", sounds flippin scary. But they track everyone now. And that really should be the first step, in the case of any outsider temporarily visiting. Boom, half the problem solved. Now, let's focus on the "border".

There is one force bigger than anything, demographics. First, recognize Mexican citizens as a labor force, documented, taxed under Mexican authority, freely moving across the border, on a daily basis. And even better, like around here, maybe three months out of the year across the border, then come back.

It is when they overstay that VISA that they are in an "unlawful presence" state.

Now, being in an "unlawful presence" state is not against any law. It is a civil violation. And there are lots of exceptions. If you are under 18, can't be unlawfully present. If you petitioned for amnesty and are awaiting your hearing, you are not unlawfully present. If you entered as a refugee, you are not unlawfully present until your refugee status if revoked. If you are a beneficiary of Family Unity Protection you are not unlawfully present unless your application is denied. If you are a victim of violence against women and children, you are not in an unlawfully present state provided your show abuse is linked to you becoming unlawfully present. And finally, victims of sex trafficking are not subject to the unlawfully present state.

So the question was a legit question. The answer was rife with outright ignorance.
