Absolutely right. Trump wants to cede as much power to AI tech as he can: All at the expense of our privacy.

The states are the ones on the vanguard standing up for the rights of the people.

They have already had an AI, that was contacted by a suicidal 16 year old, telling of wanting to commit suicide and the AI told him how and encouraged it.

  • Legal reality: The President cannot directly repeal state laws. Federal preemption can occur only when (a) Congress enacts a law that expressly preempts states, or (b) a valid federal regulation or statute occupies the field or conflicts with state law. An executive order alone cannot unilaterally nullify state statutes; it can direct federal agencies to pursue preemption strategies, challenge state laws in court, or push for federal rules that would preempt states.
  • Practical path: An EO could (and draft reporting says it would) create task forces, direct agencies (FTC, FCC, etc.) to set national rules, and authorize litigation against state laws — all ways to try to limit state action. Those moves would trigger court challenges and political pushback.
  • Political constraints: Congress, state attorneys general, and some members of Trump's own party have opposed sweeping federal preemption of state AI laws; courts would be the ultimate arbiter if agencies or the administration try to displace state rules.

Bottom line: He can try to centralize AI regulation via an EO (and reports say he will), but an EO cannot automatically override state laws — any nationwide preemption would require lawful federal authority, legal challenges, or new federal legislation. :)
