Selective prosecution is almost impossible to prove and they could not do so at trial. This has already been adjudicated or at least had the opportunity to be adjudicated.There is such a thing as selective prosecution. In fact all prosecution is selective. As to prosecuting someone for "illegally protesting" that is an idea that would be more at home in iran than here in the united states. the law bans blocking entrances to clinics and trying to intimidate the staff or the patients. Those things were already against the law. In every state and are typically enforced by local police and decided in county or state courts.
