If congress approves it, and the president signs it, how could a spending bill be unconstitutional.

If provisions within it, are unconstitutional, they are removed by the courts, the rest of the bill remains intact.

How congress spends money may be illegal, like when Reagan funded the Contra rebels. But even illegal spending isn't unconstitutional.
