Trump EO on birthright citizenship would make Kamala Harris a noncitizen

Kammy wanted to be a lawyer but knew she didn't have the brains to graduate from a law school and pass the bar exam. So when she was 20 or so she falsely claimed to be black to get affirmative action. Elizabeth warren did the same with her indian ( aka pre-american) lie. Millions of americans have falsely claimed "protected class" status to get affirmative action.

To hold that the Fourteenth Amendment of the Constitution excludes from citizenship the children, born in the United States, of citizens or subjects of other countries would be to deny citizenship to thousands of persons of English, Scotch, Irish, German, or other European parentage who have always been considered and treated as citizens of the United States.
In short the phrase “and subject to the jurisdiction thereof” excludes three and only three groups of people:

  • Children born to foreign diplomats here on diplomatic business, who have diplomatic immunity to US Law;
  • Children of members of an invading army that has occupied and controlled some part of US territory, born on that occupied area, who are obviously not subject to US Law (which has rarely happened in the US, although Guam was occupied during WWII, and parts of Alaska, and small parts of Maine during the War of 1812); and
  • Members of Native American tribes, subject to the jurisdiction of their tribal governments, who do not pay US taxes. (This was true when the 14th amendment was passed, but it no longer is. See section below on the act that changed it in 1924.)

The justices limited the ability of lower-court judges to issue nationwide injunctions, including those that halted his ban on birthright citizenship, while litigation is pending on the policy at issue. At the same time, the court left open a path for challengers to continue to try to block the ban, and paused Trump’s executive order ending birthright citizenship for U.S.-born children of undocumented immigrants and foreign visitors for at least 30 days.

Fred Trump (b. 1905, d. 1999) was born in the Bronx to German immigrant parents. Trump's mother is Scottish immigrant Mary MacLeod (b. 1912, d. 2000). Mary was born on the Isle of Lewis, the largest island of the Western Isles in Scotland.

Trump’s executive order doesn’t apply retroactively, so it wouldn’t affect anyone born before Feb 19, 2025—including Kamala Harris. And even if it tried to, the Constitution forbids retroactive punishment (Article I, Section 9), and the 14th Amendment guarantees birthright citizenship to anyone born on U.S. soil, regardless of their parents' visa status.


This was settled in Wong Kim Ark over a century ago, and no executive order can override the Constitution. Harris was born in Oakland, California—that makes her a natural-born citizen, full stop.
