How a Conviction Happens
A conviction can only be achieved in one of two ways during a criminal court case:- A Guilty Verdict: Following a trial, a judge (in a bench trial) or a jury unanimously decides that the prosecution has proven the defendant's guilt beyond a reasonable doubt.
- A Plea Bargain: The defendant waives their right to a trial and enters a formal plea of guilty or no contest (nolo contendere) to the court. Legally, this has the same effect as being found guilty after a full trial.
