We can argue that since it will be connected to the WH, it is a renovation to the East Wing, not a new building.

#2 It would be interesting if that were to piss off Congress enough to actually take action. Such as canceling the business licenses and various certifications of the business entities involved. Under the US Constitution Congress has control of the district (Article I, Section 8) so if Congress were to suspend the ability for the construction firms to perform actions, that would be a civil matter beyond the Presidents pardon powers (which are for crimes only).
