The problem is that would probably require an amendment, as the Constitution lists "persons" specifically.

And it doesn't include the whole "subject to the jurisdiction thereof" qualifier the 14th amendment has that "may" give us an out on birthright citizenship.

If I'm not mistaken, illegal aliens are only protected by the 5th and 14th amendments. Sure they're free to roam around the country, but I wouldn't consider them "free persons." They're subject to being detained at any time and deported out of the country.
