Leading me to ask another question, similar to the philosophical one that begins "If a tree falls in the forest........" In practical terms, if the government breaks the law, but there is no one to enforce it, has the law been broken?

I’m 100% sure they would have Sabotaged the Mission even if it would cause US CasualtiesI can think of a few reasons. One, getting a declaration from Congress would have made it public knowledge allowing Maduro to prepare for this. Instead of a quick in and out Delta Force strike team taking him into custody it would have become something incredibly bloody. The 40 dead were Maduro's people. The bomb strikes were precision targets meant as distractions.
The second reason, even if Congress had been briefed under classified proceedings, someone in the Democratic Party would have possibly leaked it.
