I try to consider the arguments of everyone. I try to see the issue through your eyes. But logic keeps getting in the way. According to you the workers building the house had tools stolen. So they continue to leave tools laying around and don’t file police reports. I find that hard to believe since those tools are the literal livelihoods of those workers. When I had construction workers at my house they locked up their tools in a trailer every night. That was after they found out that I had a camera that covered the area the trailer was in. Before that they took the trailer with them when they left.

But OK. Let’s pretend that they continued to leave their expensive tools laying around. Trespassing can not be claimed by anyone but the owner or his representative. Nobody there was designated a representative. If they had been they would have been identified before now.

So that leaves burglary. The value of the stolen items must be more than $500. No hammer would qualify. So it would be a misdemeanor.

Even if you were right. It would not help the McMichaels. Their actions remain Felonies even if you are right on every insane theory you have. It is still a Felony to ram him with your car. It is still a felony to confront him with a shotgun. It is still a felony to try and detain him. And that means the death is still a Felony.

So even if you were right. It does not help the McMichaels. They are still the biggest criminals in the entire incident.

Factually, you are not quite correct.

I posted the statute earlier in the thread, in Georgia, burglary is defined as entering a dwelling with the intent to steal. Meaning you could actually be charged with burglary even if you didn't steal ANYTHING if the DA can prove intent. The amount is meaningless in that context.

By the way, I believe that is actually the same in every state.

The problem for the rednecks of course is that the Georgia statute covering citizen's arrests says that you must have first hand knowledge of a felony to affect a citizen's arrest. Meaning unlike police who could simply arrest you for being on the property to begin with and THEN add charges if they determine that you had intended to burglarize the place, citizens are more limited in what they may do,

Even if Arbery DID commit a felony (which burglary is) these fools had absolutely no first hand knowledge of that, we know this because they admitted to cops that they wanted to question him to see if he had done anything wrong. They weren't even 100% sure he was the guy on property, they damn sure didn't know his intent.
