We have recognized it since 1868 and the passing of the 14th Amendment. Southern rebel states that seceded during the Civil war were required to accept it, in order to regain representation in Congress and Senate. Poorly crafted (for your purposes), maybe, but is the law of the land. I doubt it will change until another amendment is passed, or at the very least a bill passed in both houses of congress regulating it, and even that would be challenged up to the Supreme Court. Amendments are the slowest method of change, especially with the history of Congress, loath to take up significant legislation, hoping they will not have to take any stand, that might hurt them at the polls, totally gutless, in general.

Our Supreme Court now has a majority of constitutionalists even if one or two are politically wishy washy. I'm pretty sure if Congress clarifies the Founders intent with legislation, SCOTUS will uphold it.
