None of what he had, was he authorized to have.

And no, biden didn't comply willingly, if he had those boxes would have been returned 30 years prior.

It blew up under trump, and biden had an "oh shit " moment, and had his lawyers scour through thr boxes before letting the FBI come and get them.

#1 The law required "willful" intent to take classified documents. Since Pence, Biden and Trumps materials were packed by others, the ability to directly prove willful intent is about non-existent. Which is Trump wasn't charged with taking the documents, same applies to Pence and Biden.

#2 Trump was charged with willful intent to not return national defense information (classified documents) to authorized Officers of the United States Government (including officers of the NARA, the FBI, and failing to comply with a Federal subpoena).

The refuse to recognize the difference.

Federal prosecutors questioned former Trump aide Kash Patel on Thursday about his previous claims that former President Trump had declassified documents recovered from Mar-a-Lago, The Washington Post reported.

Patel appeared for the second time in a month before a federal grand jury investigating Trump’s handling of classified documents after the Department of Justice agreed on Wednesday to grant him immunity for any information he provided.

The former Trump aide was also asked about how and why the former president took classified records with him to Mar-a-Lago, according to the Post.

Patel previously said in media interviews that he had witnessed Trump issue declassification orders near the end of his presidency, particularly on the FBI’s investigation into possible collusion between the Trump campaign and Russia.


Patel’s grand jury appearance was his second in less than a month. At his first appearance in October, he asserted his Fifth Amendment right against self-incrimination, according to people familiar with the matter who spoke on the condition of anonymity to discuss the situation. Prosecutors argued he was not in legal jeopardy and therefore could not take the Fifth, but a federal judge disagreed with the government.
Prosecutors ultimately decided to grant Patel limited-use immunity, the people familiar with the matter said, meaning he could not be charged for a crime based on what he said in the grand jury, as long as he didn’t lie.


The problem for Kash (beyond his taking the 5th to protect himself from self incrimination, not a good look for the head of the FBI) is Jack Smith's indictment of Dotard and his co-defendants state trump in fact did not declassify the docs he stole.

Paradoxically, if Kash was telling the truth..........which he isn't.........it would mean trump declassified highly sensitive docs so he could........what........show them off to guests at MAL? Nah, he'd never do that.

FBI director nominee Kash Patel paid by Russian filmmaker close to Kremlin: Report


President Donald Trump’s nominee to be FBI Director, Kash Patel, was paid $25,000 by a Russian filmmaker with connections to the Kremlin, The Washington Post reports.

Documents obtained by the paper reveal that Patel was paid by Global Tree Pictures, a film company owned by Igor Lopatonok, a Russian national who also holds U.S. citizenship.

Lopatanok has produced shows pushing U.S. “deep state” conspiracy theories and views skeptical of the West, which are also relentlessly promoted by the Kremlin, a financial disclosure form submitted by Patel as part of his confirmation process revealed.


Pretty cut and dry, right? The FBI director nominee took money from a Russian propagandist to be in one of his productions. The one Patel was paid for was an anti-FBI propaganda film. Aside from all the other disqualifying things attributed to Kash can Repub senators look past this one too? We'll find out next week.

I have no problem with him getting copies of Presidential Records.

All he has to do was turn over the originals to the National Archivist then get copies.

He can even request that the current President declassify classified documents. But then the decision is up to the current President, not the civilian former President.
