Damage does not have to be the intent. Only the publishing of information that you know to be untrue.
As an example. Letâs say that MSNBC has a guest on that claims to be a former Secret Service Agent who knows first hand that Donald Trump sacrifices Mexican Girls on the Blue Moon at midnight as part of a satanic ritual.
Right now, MSNBC will be covered. They believe the witness is telling the truth. But if later during a lawsuit discovery it is found that the hosts and managers knew that the report was a lie. Well MSNBC is now liable.
The problem from your point of view is that you believe the baseless allegations. So you think Fox and Newsmax is doing a great job getting the truth out there.
The messages attached and included in the filing show that Fox hosts that you lionize, knew it was untrue. They didnât call their âGuestsâ on the lies.
They arenât airing opposing views. They are promoting those views. Iâm old enough to remember when Hannity was paired up with Colmes. That was a good show. I watched it often. They presented opposing views and let you decide.
But those old shows were rooted in reality. They were based in truth. Truth is sadly lacking. And Fox is liable to pony up a lot of money for the choices theyâve made.
