Leaving office is NOT 'in the performance of Executive duties'.

1. Biden did NOT have the authority to declassify TS/SCI documrnts

2. Biden did NOT have legal authority to remove RS/SCI docimrnts from a SCIF

3. Biden did NOT legally move / transport TS/SCI documents

4. Biden did NOT legally store the TS/SCI documents he stole in a SCIF.

5. Biden did NOT maintain control of the TS/SCI documents he stole
- He didn't even know where all of them were

6. Biden did / does NOT have a Chain of Custody for all the different batches of his classified documents, meaning there is no record of how many batches of classified documents there were / are, how many times they were moved, where they were moved to / from over tbe last 6 years.

7. Biden does NOT have visitor logs for the Penn-Biden-ChiCom Center, his house, or his garage, so there is no record of who had access to these highly classified, National Security-endangering documents.

The difference is that Biden came clean over relatively few documents, while Trump hid his transgressions over many more. If Trump had just turned all the documents over as the NA asked, none of this would have happened.
