The point is the Senate rule requiring 60 votes to close cloture to get a majority vote for a SC Justice is the present rule. That Senate rule could be changed to include SC Justices with a simple majority vote. That is how Reid did it with 52 votes for the present rule change.

The dems have to be realistic: the next nominee will replace Scalia....and not just the empty seat, but the man himself. That's just how it is.
