Correct....when charged with illegal entry as a misdemeanor criminal offense, the illegal has to be given due process, and be formally charged, taken to trial and if the illegal entrant loses, can be deported or held in prison for their sentence then deported. If this convicted of the misdemeanor and deported person tries to reenter the United States again and caught, they can be charged with a felony for illegal entry and again, given due process and a trial etc etc is my understanding.

If not brought to court for the misdemeanor criminal charge, then I believe it is a civil violation deportation....

Which is Trump's out to mass deportation because only misdemeanor criminal charges and or felony criminal charges, requires due process...a trial first because prison can be an outcome, which demands due process for the accused.

But the civil violation of illegal entry, never has imprisonment as a punishment, only fines and deportation back to where they came which a SC ruling is my understanding, confirmed that....

There are other stipulations involved that are a part as well like distance from the border, under 2 yrs living here....

Our entire problems rests on having enough judges in immigration court, so that within 2 weeks these asylum seekers have their required immigration court hearing, and when denied, and depending on the world's situation in other nations, the immigration courts on average have found around 90% do not meet the qualifications for asylum....

...they would be sent back home two weeks later, all their fellow home country citizens would see this and discourage the caravans and exodus because selling everything they own, to make the trip to the USA, only to be back in their home country within the month, with no home, no money left, and no job, no possessions etc. is a major deterrent....

This tees up some latitude in the Supreme Courts upcoming 14th Amendment decision.
They seem to open to the concept that we are seeing an actual invasion (which we are) and invasion is an explicit exclusion for birth right citizenship under the 14th amendment
