State department had no investigation. Congress was not investigating Clinton.

Furthermore, you couldn’t make a case she had any intention to impede, obstruct or influence any investigation. Congress wasn’t investigating her personal emails.

For the statute to apply, they have to be a target of a particular investigation, and or get a retention letter. So not just any investigation. Otherwise somebody whose a target would have to retain everything they touch, down to the tissue they blew their nose into.
