The constitution binds the federal government, and thereby the enumerated rights of the Bill of Rights are not binding on the states, except where explicitly stated. The protections of the Bill of Rights were only incorporated to the states after passage of the 14th amendment. But the 14th amendment only applies to ex-slaves, so that's nobody alive today.
